Welcome to Endless Memories QR ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your use of our website located at www.endlessmemoriesqr.com (the "Site") and our digital memorial services (the "Service").

By purchasing our products or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Description of Service

Endless Memories QR provides physical stainless steel plaques engraved with QR codes that link to digital memorial profiles hosted on our platform. The Service allows users to upload text, photos, and videos to honor their loved ones.

2. Purchases and Refunds

  • Custom Orders: All plaques are custom-engraved. Once an order has been moved to production (typically 24 hours after purchase), cancellations are not accepted.

  • Refunds: We offer a 100% satisfaction guarantee on the physical quality of the plaque. If your plaque arrives damaged or with an engraving error caused by us, we will replace it free of charge. We do not offer refunds for "change of mind" once the product is shipped.

  • Pricing: We reserve the right to change product pricing at any time.

3. User Content and Conduct

You retain all rights and ownership of the photos, videos, and text ("User Content") you upload to a memorial profile.

By uploading content, you agree that:

  1. You have the necessary rights and permissions to share the photos/videos of the deceased.

  2. You will not upload content that is illegal, offensive, defamatory, hate speech, or explicit.

  3. We reserve the right to remove any content that violates these Terms without prior notice.

4. The "Forever" Guarantee

We market our service as a "Forever" memorial. By this, we mean:

  • No Subscriptions: You will never be charged a monthly or annual fee to keep the profile active.

  • Data Retention: We utilize enterprise-grade cloud storage (Google Firebase) to ensure data redundancy and longevity.

  • Business Continuity: In the unlikely event that Endless Memories QR ceases operations, we will make a reasonable effort to provide users with a way to download their data or transfer their profile to an alternative host. We cannot be held liable for data loss due to catastrophic server failure or events beyond our reasonable control (Force Majeure).

5. Acceptable Use of Plaques

  • Permission: You agree that you have the legal right or permission from the cemetery, columbarium, or land owner to place the adhesive plaque on the headstone or urn. Endless Memories QR is not liable for plaques removed by cemetery groundskeepers due to violation of their specific rules.

  • Vandalism: While our plaques are weatherproof and durable, we are not responsible for theft or vandalism of the physical plaque once it is placed.

6. Intellectual Property

The website design, logo, and underlying code of the Endless Memories QR platform are the intellectual property of the Company. You may not copy, reverse-engineer, or resell our digital platform.

7. Limitation of Liability

To the maximum extent permitted by law, Endless Memories QR shall not be liable for any indirect, incidental, or consequential damages resulting from:

  • The use or inability to use the Service.

  • Unauthorized access to your data (despite our security measures).

  • Any conduct or content of any third party on the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Indiana/United States], without regard to its conflict of law provisions.

9. Changes to Terms
